1. Acceptance of These Terms

These Terms of Use (“Terms”) govern your access to and use of www.safecommunityproject.org and other websites, webpages, digital services, and online resources operated by Safe Community Project that link to or incorporate these Terms (collectively, the “Site”).

The Site is operated by Safe Community Project, a California nonprofit public benefit corporation and tax-exempt 501(c)(3) public charity (“Safe Community Project,” “SCP,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to these Terms. If you do not agree with these Terms, please do not use the Site.

We may revise these Terms periodically as our programs, services, technology, or legal requirements change. Updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

2. Purpose of the Site

Safe Community Project uses the Site to provide information about our nonprofit mission, programs, public-safety initiatives, educational services, community activities, research, media, training, partnerships, and related resources.

Some portions of the Site may provide access to registrations, educational materials, downloadable resources, forms, event information, videos, publications, applications, or links to services offered through other platforms.

The availability of particular content or services may change without notice.

3. Public-Safety and Emergency Information

Safe Community Project provides public-safety and emergency-preparedness information for educational and informational purposes.

The Site is not an emergency notification, dispatch, evacuation-order, warning, or incident-command system.

Information provided through the Site should not be relied upon as a substitute for official emergency instructions, evacuation orders or warnings, alerts, directions from first responders, medical advice, building or fire-code requirements, or information provided by government agencies having jurisdiction.

Wildfires, earthquakes, structure fires, floods, severe weather, and other emergencies are dynamic events. Conditions, evacuation routes, road access, hazards, agency instructions, and recommended actions can change rapidly.

In an emergency:

• Call 911 or the appropriate local emergency number when emergency assistance is required;
• Follow instructions issued by fire, law-enforcement, emergency-management, public-health, and other authorized agencies;
• Use official emergency-alert and notification systems applicable to your community; and
• Do not delay protective action while attempting to obtain information from this Site.

Safe Community Project does not guarantee that information appearing on the Site will reflect current conditions during an active emergency.

4. Educational Information; No Professional Advice

Content provided through the Site is intended primarily for education, preparedness, public awareness, and general informational purposes.

Although Safe Community Project works with public-safety professionals, agencies, subject-matter experts, and community partners, information on the Site does not constitute legal, engineering, architectural, medical, insurance, financial, code-compliance, or other licensed professional advice unless expressly stated otherwise.

Information concerning wildfire preparedness, home hardening, defensible space, evacuation readiness, community risk reduction, building practices, or similar subjects may be affected by local ordinances, state law, regulations, site conditions, property characteristics, agency policies, and changes in recognized practices.

Users are responsible for determining the requirements applicable to their particular circumstances and, when appropriate, consulting the relevant governmental agency or qualified professional.

5. Permitted Use

Subject to these Terms, Safe Community Project grants you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Site for lawful purposes.

Unless otherwise indicated, you may view, download, or print materials made available for that purpose for your personal, educational, or other authorized noncommercial use, provided that you retain applicable copyright, trademark, attribution, and other proprietary notices.

The availability of material for viewing or downloading does not transfer ownership or intellectual-property rights in that material.

Separate permissions, licenses, agreements, or usage terms may apply to particular publications, videos, courses, photographs, presentations, applications, data sets, training materials, or other resources.

6. Prohibited Uses

You may not use the Site:

• For any unlawful, fraudulent, abusive, or malicious purpose;
• To obtain unauthorized access to the Site, servers, accounts, systems, networks, databases, or services;
• To bypass, disable, interfere with, or defeat security or authentication measures;
• To probe, scan, or test vulnerabilities without express written authorization;
• To introduce viruses, malware, malicious code, or other harmful technology;
• To interfere with the operation, performance, or availability of the Site;
• To impersonate Safe Community Project, its personnel, its divisions, its partners, or another person or organization;
• To falsely imply endorsement, sponsorship, affiliation, certification, or authorization by Safe Community Project;
• To harvest personal information or credentials from Site users;
• To copy, reproduce, extract, republish, or commercially exploit Site content except as expressly permitted;
• To circumvent technological measures used to control access to restricted materials; or
• To use automated systems in a manner that places an unreasonable load on the Site, interferes with its operation, violates these Terms, or is intended to reproduce or commercially exploit substantial portions of Site content.

Ordinary indexing by legitimate public search engines and accessibility technologies used by individuals with disabilities are not prohibited by this section.

7. Intellectual Property

Unless otherwise indicated, the Site and its original content—including text, photographs, graphics, artwork, illustrations, video, audio, films, animations, presentations, educational materials, publications, logos, design elements, interfaces, and other original works—are owned by, licensed to, or used with permission by Safe Community Project.

Such material may be protected by United States and international copyright, trademark, and other intellectual-property laws.

Except where expressly authorized, no Site content may be copied, reproduced, modified, republished, transmitted, publicly displayed, distributed, sold, licensed, incorporated into another work, or used to create derivative works without appropriate permission.

Nothing in these Terms transfers to you any ownership interest in Safe Community Project intellectual property.

8. Safe Community Project Names, Marks, and Branding

Names, logos, program identities, slogans, service marks, trademarks, and other branding used by Safe Community Project and its divisions or programs are the property of their respective owners.

Use of a Safe Community Project name, logo, mark, badge, graphic identity, or other branding does not imply permission, endorsement, sponsorship, partnership, or affiliation.

You may not use Safe Community Project branding in a manner likely to cause confusion regarding the source, sponsorship, certification, approval, or affiliation of a product, service, organization, event, publication, website, or other activity without prior written authorization.

Third-party names, logos, and marks appearing on the Site remain the property of their respective owners.

9. Photographs, Video, Audio, and Media

Safe Community Project produces and distributes original educational, documentary, public-safety, promotional, and training media.

Unless otherwise specified, video footage, photographs, audio recordings, graphics, animations, interviews, finished programs, and other media produced or owned by Safe Community Project may not be downloaded, reproduced, edited, republished, rebroadcast, redistributed, commercially exploited, or incorporated into another production without prior written permission.

Sharing a link to publicly available Safe Community Project content through normal social-media or linking tools is generally permitted, provided the content is not altered and the sharing does not falsely imply endorsement or affiliation.

Additional terms may apply to licensed footage, training productions, client-specific productions, third-party materials, music, photographs, or other content for which Safe Community Project does not control all underlying rights.

10. Third-Party Content and External Links

The Site may contain links to websites, platforms, applications, documents, products, services, agencies, organizations, or other resources operated by third parties.

These links are provided for information, reference, convenience, or educational purposes. Unless expressly stated otherwise, a link does not constitute an endorsement, sponsorship, warranty, or recommendation by Safe Community Project.

Safe Community Project does not control third-party websites and is not responsible for their content, availability, security, accessibility, privacy practices, accuracy, products, services, or terms.

Your use of a third-party service is governed by the policies and terms of that third party.

11. Government Agencies and Partner Organizations

Safe Community Project works with numerous governmental agencies, public-safety organizations, nonprofit organizations, educational institutions, community organizations, private entities, and other partners.

References to, or appearances by, these organizations on the Site do not necessarily mean that they endorse every statement, program, publication, recommendation, product, or service provided by Safe Community Project.

Likewise, Safe Community Project’s collaboration with a governmental agency does not make Safe Community Project a governmental agency, nor does it authorize Safe Community Project to issue official governmental orders, regulations, emergency warnings, or legal determinations unless expressly authorized to do so.

Agency seals, insignia, logos, photographs, and other third-party materials remain subject to the rights and restrictions of their respective owners.

12. User Communications and Submissions

We welcome questions, comments, feedback, and other appropriate communications.

Unless Safe Community Project specifically requests a submission under stated terms, please do not send unsolicited confidential business information, proprietary concepts, unpublished creative works, scripts, production concepts, inventions, or other materials that you expect us to maintain as confidential.

Ordinary communications sent through the Site will not create a confidential, fiduciary, employment, partnership, agency, or other special relationship between you and Safe Community Project.

You retain whatever intellectual-property rights you otherwise possess in materials you submit to us. By voluntarily submitting material for publication, consideration, community engagement, testimonials, photographs, stories, or similar purposes, you represent that you have the right to submit it.

Any license or permission required for Safe Community Project to use submitted material should be established through the applicable submission form, release, agreement, or other authorization.

Nothing in these Terms should be interpreted as automatically transferring ownership of every email, idea, comment, or communication sent to Safe Community Project.

13. Forms, Registrations, Accounts, and Restricted Services

Certain portions of the Site or related services may require registration, account creation, enrollment, or submission of information.

You agree to provide accurate and current information when required and to update information when appropriate.

If login credentials are provided, you are responsible for maintaining their confidentiality and for activity conducted through your account. You may not knowingly permit unauthorized persons to use restricted credentials or access materials that have been licensed or provided specifically to you or your organization.

Safe Community Project may suspend or terminate access where reasonably necessary to protect users, enforce agreements, maintain security, investigate misuse, or protect the integrity of its services.

Additional terms may apply to courses, events, certifications, training platforms, assessments, applications, paid services, or other specialized programs.

14. Payments, Donations, and Third-Party Payment Services

The Site may provide opportunities to register for programs, purchase services or materials, make donations, or complete other transactions.

Payment processing may be performed by third-party payment providers. Safe Community Project does not necessarily receive or store complete payment-card information when transactions are processed through these services.

Additional cancellation, refund, registration, donation, or program terms may apply to individual transactions and will control where they conflict with these general Terms.

Tax deductibility of a contribution depends on applicable law and the circumstances of the contribution. Donors should consult their own tax advisors regarding individual tax matters.

15. Privacy

Information collected through the Site is handled in accordance with Safe Community Project’s applicable Privacy Policy and related notices.

Third-party services linked to or embedded within the Site may collect information under their own privacy policies.

Users should review the privacy practices applicable to services they choose to use.

16. Accessibility

Safe Community Project is committed to improving access to its digital information and services for people with disabilities.

17. No Warranty

Safe Community Project works to provide useful, timely, and accurate information. Nevertheless, websites and digital information can contain errors, omissions, outdated information, technical problems, or interruptions.

To the fullest extent permitted by applicable law, the Site and its content are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or uninterrupted operation.

Safe Community Project does not warrant that:

• The Site will always be available or error-free;
• Information will always be current, complete, or suitable for a particular purpose;
• Defects will always be corrected immediately;
• The Site or servers will be free from harmful components; or
• Information obtained through external links or third-party services will be accurate or reliable.

Nothing in this section limits rights that cannot lawfully be waived.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Safe Community Project and its directors, officers, employees, volunteers, contractors, agents, divisions, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to use of, inability to use, or reliance upon the Site or its content.

This includes, without limitation, losses arising from unavailable services, inaccurate or outdated information, third-party websites, data loss, interrupted communications, malicious software, unauthorized access, or reliance upon Site information during an emergency.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Safe Community Project and its directors, officers, employees, volunteers, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the Site, violation of these Terms, infringement of another person’s rights, or misuse of Safe Community Project content or services.
